Institutional Framework

The CNP-PPP is the decision-making, validation and orientation body of the institutional framework for steering public-private partnerships in Côte d’Ivoire. It was created in 2012 by two (2) decrees: Decree No. 2012-1151 of 19 December 2012 on Public-Private Partnership Contracts and Decree No. 2012-1152 on the powers, organisation and operation of the institutional framework for steering public-private partnerships.

  • In 2018, the institutional framework for PPPs was reformed with the adoption of two new decrees:
  • – Decree No. 2018-358 of 29 March 2018 determining the rules relating to public-private partnership contracts (download Decree);
  • – Decree No. 2018-359 of 29 March 2018 on the powers, organisation and operation of the National Steering Committee for Public-Private Partnerships (download Decree)

With these new texts, the CNP-PPP is now placed under the authority of the Prime Minister.

Missions

In accordance with Decree No. 2018-359 of 29 March 2018 on the powers, organisation and operation of the National Steering Committee for Public-Private Partnerships, the CNP-PPP’s missions are:

    1. To promote the development of PPPs in Côte d’Ivoire and in particular:
  1. To elaborate the national strategy for the development of PPP contracts in the medium and long term
    1. To validate, in collaboration with the contracting authorities, the annual programme of projects to be carried out under PPP contracts, to ensure the monitoring and evaluation of the implementation, in collaboration with the contracting authorities, and produce an annual report on the progress of the programme each year, with useful recommendations to improve its implementation and contribute to the development of a favourable environment for PPPs
    2. To develop specific expertise in the legal and financial structuring of PPP contracts
    3. To provide support to the contracting authorities at the various stages of PPP implementation

In this respect, the CNP-PPP provides advice and expertise in the context of which, at the request of the contracting authorities, and carries out all or part of the following actions:

  1. Carry out, on behalf of the contracting authorities, the preliminary legal and financial feasibility studies of any project likely to be developed as a PPP, as required by the aforementioned Decree No. 2018-358 of 29 March 2018
  2. Assist the contracting authorities at the stage of the award of PPP contracts for:
  • The optimal legal and financial structuring of draft PPP contracts,
  • The choice of procurement procedures and the preparation of consultation documents and draft PPP contracts,
  • The conduct of these procedures, including during the negotiation or finalisation phases of the contracts, until they are signed.
  1. Assist the contracting authorities in the execution of PPP contracts, including: 
  • In the event of amendments to PPP contracts, in particular when amendments are being concluded,
  • For the determination, implementation or modification of the financing conditions,
  • In the settlement of disputes between the parties.

 

To manage the study fund dedicated to PPPs.

Vision

Our vision is to increase the involvement of the private sector in the development of the Ivorian economy and make Côte d’Ivoire a reference for PPP management in Africa.
