About CNP-PPP

Institutional Framework

The CNP-PPP is the decision-making, validation and guidance body of the institutional framework steering public-private partnerships in Côte d'Ivoire. It was set up in 2012 by two (2) decrees: Decree No. 2012-1152 of 19 December 2012 on Public-Private Partnership contracts and Decree No. 2012- 1151 of 19 December 2012 on Public-Private Partnership contracts.

In 2018, the institutional framework for PPPs was reformed with the adoption of two new decrees:

  • Decree no. 2018-358 of 29 March 2018 setting out the rules for public-private partnership (download decree);
  • Decree no. 2018-359 of 29 March 2018 on the remit, organisation and operation of the National Steering Committee for Public-Private Partnerships (download decree)

With these new texts, the CNP-PPP is now placed under authority of the Prime Minister.

Missions

In accordance with Decree No. 2018-359 of 29 March 2018 on the remit, organisation and operation of the National Steering Committee for Public-Private Partnerships, the CNP-PPP's remit includes:

  1. promote the development of PPPs in Côte d'Ivoire, in particular:

    1. draw up the national strategy for developing PPP contracts in the medium and long term.

    2. to validate, in collaboration with the contracting authorities, the annual programme of projects to be carried out under PPP contracts, to monitor and evaluate its implementation, in collaboration with the contracting authorities, and to produce an annual report on the progress of this programme, together with any useful recommendations for improving its implementation, and to contribute to the development of a "PPP culture". PPP-friendly environment.

    3. develop specific expertise in the legal and financial structuring of PPP contracts.

  2. provide support to the contracting authorities at the various stages of the PPP process; at the request of the contracting authorities, it carries out some or all the tasks in particular following actions:

    1. carry out, on behalf of the contracting authorities, the preliminary legal and financial feasibility studies for any project likely to be developed in the form of PPP, as required by the Decree No. 2018-358 of 29 March 2018;

    2. assisting contracting authorities at the PPP contract award stage:

      • optimal legal and financial structuring of PPP contract projects;

      • the choice of procurement procedures and preparation consultation documents and draft PPP contracts;

      • the conduct of these procedures, including during the negotiation or finalisation phases of the contracts, until they are signed;

    3. help the contracting authorities in performance of PPP contracts, and in particular:

      • in the event of amendments to PPP contracts, when riders are signed;

      • for the determination, implementation or modification of financing conditions;

      • as part of the settlement of disputes between the parties.

  3. managing the PPP study fund.
